Terms and Conditions

1. STANDARD TERMS

1.1. Information on how to enter forms part of the terms and conditions (“Terms and Conditions”). Participation in this Competition is deemed acceptance of these Terms and Conditions.
 

2. WHO CAN ENTER?

2.1. Subject to clause 2.2 entry is open to all residents of Australia aged 18 years and above.

2.2. Employees and their immediate friends and families of GENERAL MOTORS AUSTRALIA AND NEW ZEALAND PTY LTD ABN 84 006 893 232 trading as ‘GM Specialty Vehicles (the “Promoter”), and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
 

3. HOW TO ENTER

3.1. The Competition commences on Monday 14th August 2023 at 00:00AEST and concludes on Thursday 24th August 2023 at 23:59AEST (the “Competition Period”).

3.2. In order to participate in the Competition, entrants must:

a) Log onto their Instagram account and follow @gmspecialtyvehicles (https://instagram.com/gmspecialtyvehicles) and remain following the account until the end of the Competition Period;

b) View the competition story on @gmspecialtyvehicles Instagram account

c) Submit their entry of them and or their Dad's in action with their SIlverado's, by using the 'Add Yours' stories sticker & tagging @gmspecialtyvehicles.

3.3. Entrants may enter the competition as many times as they like throughout the competition period.

3.4. Entries must be received by Thursday 24th August 23:59AEST.
 

4. PRIZES

4.1. There will be One (1) Prize Winner in total, with the Winner receiving the following Prize

4.2. The total prize pool value is $199.00. Prize value is correct as of 9th August 2023. The Promoter takes no responsibility for changes to Prize value.

4.3. Prize cannot be exchanged, transferred or traded for an alternative prize unless otherwise advised.
 

5. HOW TO WIN

5.1. There will be One (1) Prize Winner in total. Each entrant who has entered the Competition during the Competition Period in accordance with clause 3.2 (“Qualifying Entrant”) will be considered in the judging.

5.2. The judging will be conducted by the promoter at 80 Turner St, Port Melbourne and the winner will be determined by the most deserving, creative and unique entry, in the sole opinion of the promoter.

5.3. The Finalists will be notified via Instagram within two (2) business days of judging to collect their contact details including (but not limited to) e-mail address and phone number.

5.4. The competition is a game of skill and chance plays no part in determining the prize winner.

5.5. Prize Winner will be notified via Instagram direct message by the Promoter within two (2) business days of the Judging. The winner’s names will be published on the GMSV account @gmspecialtyvehicles (https://instagram.com/gmspecialtyvehicles)

5.6. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the result.

5.7. The Winner will be required to respond to the Promoters’ direct message on Instagram to claim their Prize within 24 hours of being notified that they are the Winner. The Winner must provide their full address and email address to receive their prize. If the Winner fail to respond and accept the Prize within 24 hours of notification and accept in accordance with these Terms and Conditions, the Prize will be forfeited by the Winner. In the event the Prize is forfeited by a Winner, the next best judged entry will be deemed the Winner.
 

6. GENERAL

6.1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

6.2. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

6.3. If for any reason the winner does not take and/or redeem a Prize (or an element of the prize) at/by the time stipulated by the Promoter, then the Prize (or that element of the prize) will be forfeited.

6.4. GMSV do not encourage or welcome entrants undertaking dangerous or reckless stunts as part of the content they submit.
 

7. INSTAGRAM

7.1. This promotion is in no way sponsored, endorsed, administered by or associated with Instagram. You are providing your information to the Promoters and not to Instagram. The information you provide will only be used for the purpose of this Competition unless otherwise specified in these terms and conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Instagram.

7.2. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with Instagram terms of use, including but not limited to clauses relating to entrants with an Instagram account who are under the age of 13 at the time of entry, which can be viewed at https://help.instagram.com/581066165581870.

7.3. This Competition adheres to the terms and conditions set out in the Instagram promotion guidelines which can be found at: https://help.instagram.com/179379842258600.

7.4. All entrants unconditionally and irrevocably release and discharge Instagram from any and all liability in relation to this Competition.
 

8. NO LIABILITY

8.1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, pandemic, COVID-19, the Promoter may in its absolute discretion cancel the Competition, subject to regulatory authority.

8.2. GMSV, and their associated agencies and companies affiliated with this competition, will take no responsibility for Prizes damaged or lost in transit, or late, lost or misdirected mail.
 

9. PROMOTER’S DETAILS

9.1. The Promoter GENERAL MOTORS AUSTRALIA AND NEW ZEALAND PTY LTD ABN 84 006 893 232 trading as ‘GM Specialty Vehicles’ of 80 Turner Street, Port Melbourne, VIC, 3207.

9.2. ‘GM Specialty Vehicles’ is collecting personal information from the Winner to enable identification of the winners and for marketing and promotional purposes for the Promoter. In addition to any required disclosures referred to in these Terms and Conditions, your personal information will be disclosed to the Promoter and their related bodies corporate for these purposes. The Promoter may disclose your personal information to other companies for the purpose of facilitating the delivery of prizes to winners. Where you provide us with personal information about another individual, you must have their consent to provide their personal information. No other use of this information will be made without your consent. If you do not provide your personal information, the Promoter will not be able to enter you into the Competition. Without limiting the foregoing, the Promoter may disclose the entrant’s personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the entrant’s relationship with the Promoter. In addition, by entering this Competition, you consent to the Promoter using your personal information for the purpose of the Promoter and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to the Promoter from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly.
